my head is spinning

I'm a little confused. The Republicans have lambasted Arlen Specter for publicly going out of bounds and explaining that the Red party didn't get a mandate in the elections, and that he basically didn't support overturning Roe v. Wade. Bush has made it clear that he doesn't want any "activist judges" "interpreting" the laws of the land. However, they have also made it clear that they are going to try to overturn Roe v. Wade. Wouldn't the process of overturning that established law involve using "activist judges" "interpreting" the laws of the land? It would seem that the Bush administration and their supporters think that "activist judges" are just peachy as long as they are "interpreting" the laws of the land in a religious way.
